No it wouldn't apply to both. As far as I know, Atheists and Agnostics are
making no claims at all, they are simply demanding evidence. Of course, if one
said "I know 100% for sure there is no god" then yes, I think a burden of
proof would be on him to present his evidence. Maybe that's would your talking
about, since the OP made a similar claim?
